These Terms of Use (the Terms) are an agreement between you and [Vitra.ai legal entity name] ("Vitra.ai", "we", "us" or "our"), with its registered office at [registered address], India. They govern your use of the Manas mobile app and the services we provide through it (together, Manas).
Please read them carefully. By creating an account or using Manas, you agree to these Terms and to our Privacy Policy (https://manas.vitra.ai/privacy), which explains how we handle your personal data. If you do not agree, do not use Manas.
If you downloaded Manas from Apple's App Store, section 29 also applies to you. If you downloaded it from Google Play, section 30 also applies. These Terms also serve as the end-user licence agreement for Manas.
The short version
This summary is for convenience only. The full Terms below are what apply.
- Manas is a study companion for college students. It records your classes and uses AI to make study material, answer questions, write and check CVs, and make short videos and pictures. It also keeps your habits, to-dos and reminders.
- You need to be 18 or older, or have your parent's or guardian's consent. Students under 18 get a protected version of Manas: no ads, no behavioural tracking and no talking faces in videos.
- Credits pay for actions in Manas. You see the price before you tap. Credits have no cash value and cannot be transferred. Credits bought in packs never expire.
- Purchases and subscriptions go through Apple or Google, and so do refunds. Subscriptions renew until you cancel them in the store.
- You need permission to record your classes. Only use your own voice, your own face and your own photo. Never use Manas to deceive or impersonate anyone.
- AI can be wrong. Manas does not guarantee grades, interviews, jobs or admissions.
- Indian law applies. You can contact our Grievance Officer at any time.
1. Definitions
In these Terms:
- Account means your Manas account.
- Credits means the units shown in your Manas wallet that you can spend on actions in Manas.
- Points means Manas Points: the status points you earn for studying, shown on your profile and leaderboards.
- Your Content means anything you provide to Manas: recordings, uploaded files, the text you type (including chat questions, CV details and scripts you edit), your face photo or selfie video, your voice sample, the photos you add to PhotoBooth, your habits and to-dos, your subjects and timetable, and your profile details.
- Output means anything Manas makes for you from Your Content: transcripts, study packs, notes, summaries, mind maps, flashcards, chat answers, CVs and CV check reports, scripts, infographics, videos and PhotoBooth pictures.
- Plan means an auto-renewing subscription to Manas sold through the App Store or Google Play.
- Store means Apple's App Store or Google Play, whichever you used.
2. Who can use Manas
2.1 Age. You may use Manas if you are 18 or older. If you are under 18, you may use Manas only with the consent of your parent or lawful guardian, who must read and agree to these Terms and the Privacy Policy on your behalf and is responsible for your use of Manas. Manas is designed for college and university students. It is not designed for or directed at children under 13.
2.2 Your age group. When you first use Manas, we ask for your date of birth. We use it once to work out your age group (under 18, 18 to 24, or 25 and over) and keep only the age group, never the date of birth. Please enter your date of birth accurately. You can set it only once.
2.3 What changes if you are under 18. If your age group is under 18:
- you will not see any ads, and rewarded videos are not available to you;
- we record only the essential events Manas needs to work (for example, that the app opened or a study pack was made), never which screens you view or what you tap, and we send nothing to Google Analytics for Firebase;
- chat questions pass stricter safety checks;
- faces in your videos do not talk: your video shows a still image of the face, with your words as captions;
- PhotoBooth is not available to you.
The same protections apply while we do not yet know your age.
2.4 Parents and guardians. A parent or guardian may contact us (section 26) to access, correct or delete the account of a student under 18 in their care.
2.5 Checks. We may ask you to confirm your age or your parent's or guardian's consent, and we may suspend an account that we reasonably believe does not meet this section.
2.6 Legal capacity. You confirm that you are able to enter into these Terms, and that you are not barred from using Manas under the laws that apply to you.
3. Your account
3.1 Signing in. You sign in with your Google account or, on iPhone, with Sign in with Apple. Manas does not have passwords of its own. The provider you choose shares your name, email address and account identifier with us, as their own terms and settings allow.
3.2 Your details. Keep your name and other details accurate. Your name appears on your CV and, as your first name and the initial of your last name, on leaderboards.
3.3 Security. You are responsible for keeping your device and your Google or Apple account secure, and for activity on your Account. Tell us at once at [support email] if you think someone else has used your Account. You can sign out of every device from Settings.
3.4 1 person, 1 account. Do not share your Account. Do not create more than 1 account to obtain credits, rewards, offers or prizes more than once.
4. What Manas offers
4.1 The service. Manas lets you record classes and turn them into study packs, review flashcards, search your material, chat with Manas, choose a companion, keep habits and to-dos with reminders, make and check CVs, tailor a CV to a job, make a Video CV, write scripts and make short videos, make PhotoBooth pictures from a photo of you, and take part in check-ins, quests, streaks, leaderboards and referrals.
4.2 Features change. Manas is new and will change. We may add, change, limit or remove features, and some features depend on your age group, your device, your consents and the settings we choose (for example, whether ads or rewarded videos are available). Where a change significantly reduces a paid feature you have already paid for, we will tell you in the app.
4.3 Internet and devices. Recording works without an internet connection, but making study packs and other Output needs a connection. You are responsible for your device, operating system and data charges.
5. Credits
5.1 What credits are. Credits are a limited, personal, non-transferable and revocable licence to use paid features within Manas. Credits are not money, a deposit, stored value or property. They have no cash value. They cannot be redeemed, refunded or exchanged for money (except where the law or the Store's refund policy requires it), and they cannot be sold, transferred, gifted, pooled or moved between accounts.
5.2 How you get credits. You can buy credits in packs, receive them with a Plan, earn them (for example through check-ins, quests, streak milestones, leaderboard prizes, referrals or rewarded videos), or receive them through a promotion or offer.
5.3 Prices. Each action shows its price in credits before you tap. We may change the price of any action at any time; the new price applies to actions started after the change. Some actions are priced per minute of audio: we work out the price from the audio we actually receive, rounded up to the whole minute. If the audio turns out longer than the price you were shown covers, we may charge the difference if your balance covers it, or otherwise stop the action and return your credits.
5.4 Holds and returns. When you start an action, we hold its credits. We charge them only if the action succeeds. If an action fails and produces nothing, or you cancel it before it starts, we return the credits.
5.5 Expiry.
- Credits bought in a pack never expire.
- Credits that come with a Plan end at the end of the period they were granted for, unless the Plan says otherwise when you buy it.
- Credits from a promotion, an offer, a reward or a grant from us may expire. If they do, we will show the expiry date in your wallet before they expire.
5.6 Which credits are used first. When you spend credits, we use the credits that would expire soonest first: Plan credits, then promotional and bonus credits, then credits you earned. Credits you bought in packs are used last.
5.7 Negative balance. If a Store refunds a purchase, or credits are reversed under section 5.8, your balance may become negative. You cannot spend credits while your balance is negative.
5.8 Fraud, abuse and mistakes. We may withhold, reverse or remove credits, points, badges, prizes or other rewards that were obtained through fraud, abuse, automation, multiple accounts, a refund, a technical error or a breach of these Terms, and we may suspend the Account involved.
5.9 When credits end. Your credits end when your Account is deleted or closed. Except where the law or the Store's refund policy requires otherwise, we do not refund unused credits.
6. Purchases and subscriptions
6.1 Through the Store. You buy credit packs and Plans as in-app purchases from Apple or Google, using the payment method in your Store account. The Store's terms apply to the payment. We never receive your card, bank or UPI details.
6.2 Prices and taxes. The Store sets the price in your country and shows it, with any applicable taxes, before you pay. Prices can differ between countries and between Stores.
6.3 When credits arrive. We add credits after we verify your purchase with the Store. If your payment is still pending, your credits arrive when it completes. If you think a purchase did not arrive, use "Restore purchases" in the app or contact us.
6.4 Plans.
- What you get. Each Plan gives you the number of credits shown when you subscribe for each period (weekly, monthly or yearly), and, where the Plan says so, no ads while you are subscribed.
- Payment. The Store charges you when you confirm the purchase.
- Automatic renewal. Your Plan renews automatically for the same period at the price then in effect, unless you cancel it at least 24 hours before the end of the current period. The Store charges the renewal within the 24 hours before the period ends.
- Cancelling. Manage or cancel your Plan in your Store account settings. Deleting the app does not cancel a Plan. Deleting your Account cancels a Google Play subscription, but only you can cancel an App Store subscription, so cancel it in the App Store before you delete your Account.
- Credits each period. We add a period's credits when the Store confirms that period's payment. Unused Plan credits end with the period, unless the Plan says otherwise when you buy it.
- Changing Plans. When a change between Plans takes effect, the credits left from your old Plan's period end at once, and the new Plan's credits are added for its period.
- Free trials and offers. If a Plan includes a free trial, the trial period does not include credits. Introductory and promotional prices apply as described when you buy.
- Family Sharing. Plan credits belong only to the account that bought the Plan. Family members do not receive credits through Family Sharing.
- Billing problems. If a renewal payment fails, the Store may give you time to fix it. We may pause your Plan's benefits until the payment succeeds.
6.5 Refunds. Refunds for purchases are handled by Apple or Google under their own policies; we cannot issue refunds for Store purchases ourselves. If a Store refunds a pack, we remove its credits and any bonus credits that came with it. If a Store refunds a Plan period, we remove what is left of that period's credits and any bonus that came with it. Section 5.7 explains what happens if this makes your balance negative.
6.6 Price changes. If the price of a Plan changes, the Store will tell you in advance and, where its rules require, ask for your agreement. You can cancel before the new price applies.
7. Rewarded videos
7.1 Who and when. Where we offer them, adult users can choose to watch a short video ad to earn credits. Rewarded videos are not available to anyone under 18 or whose age we do not know, and they never play while a class is recording.
7.2 The reward. The app tells you the reward before you watch. Credits are added only after Google confirms to us that the video was watched in full.
7.3 Limits. There are limits on how many videos earn credits each day and in any 7 days, and on the time between videos. The current limits are shown in the app; at launch they are 3 videos a day, 30 in any 7 days, at least 60 seconds apart. We may change the reward and the limits at any time.
7.4 Fair play. No credits are given for views obtained by bots, emulators, scripts, tampering, multiple accounts or any other attempt to manipulate the system, and we may reverse credits obtained that way.
7.5 PhotoBooth passes. Where we offer it, a rewarded video can give you a PhotoBooth pass instead of credits: 1 PhotoBooth picture, at most 1 pass a day. A pass is not credits. It has no cash value, cannot be transferred and can be used only for PhotoBooth. If a picture made with a pass fails or is refused, the pass comes back.
7.6 The ads. Video ads are provided by Google. We do not control which ads you see, beyond the limits we set (such as the most mature ad rating allowed), and we are not responsible for advertisers' products or websites. We may stop offering rewarded videos at any time.
8. Referral programme
8.1 How it works. You can invite a friend with your link or code. When your friend joins with it and the first action they pay for with credits succeeds, you and your friend each receive the referral reward shown in the app. At launch the reward is 50 credits each, and you also receive points.
8.2 Rules.
- Your friend must apply your link or code before their first paid action. A student can be referred only once.
- A referral counts only once per person (even after an account is deleted and made again) and once per device.
- You cannot refer yourself, and 2 students cannot refer each other.
- Monthly cap: you can receive referral rewards for at most 20 friends in each calendar month (India Standard Time). Friends who join after you reach the cap still receive their own reward.
- Share your link personally and on your own social media. Do not spam, do not post your link where it is unwelcome or against a platform's rules, do not misrepresent Manas or the reward, and do not use paid advertising, coupon sites, fake accounts or incentives you pay for.
8.3 Changes and abuse. We may change the reward, the cap or these rules, or end the programme, at any time; changes do not affect rewards already given. We may withhold or reverse referral rewards obtained in breach of these rules.
9. Points, streaks, quests, leaderboards and prizes
9.1 Points. Points measure your activity in Manas. They have no monetary value, are never spent, and cannot be bought, sold, transferred or exchanged for credits or anything else.
9.2 Streaks, quests and badges. Streaks (including habit streaks), streak freezes, quests, badges and their rewards work as described in the app at the time. We may change them at any time; rewards already given are not affected.
9.3 Leaderboards. Leaderboards rank students by the points they earned in a period. Rankings are calculated from points every night (and refreshed during the day). If 2 students have the same points, the student who first earned points in that period ranks higher. Other students can see your first name, the initial of your last name and your points on the leaderboards.
9.4 Prizes. We may award prizes to the top-ranked students on the global leaderboard for each closed day, week and month, as shown in the app. Prizes are credits only, plus badges or profile flair where stated. No cash, goods or other prizes are offered. Prizes are paid automatically after the period closes. We may change the prizes for future periods at any time.
9.5 Eligibility. To receive a prize, your Account must be in good standing. We may exclude from prizes any account that we reasonably believe is linked to abuse, testing or our team, and we may withhold or reverse a prize won through a breach of these Terms. Our decisions about rankings and prizes are final, except where the law provides otherwise.
9.6 Not sponsored by the Stores. Apple and Google are not sponsors of, and are not involved in any way with, leaderboards, prizes, quests or the referral programme.
10. Your Content and our licence
10.1 You keep your rights. You keep any rights you have in Your Content.
10.2 Output. As between you and us, and to the extent the law allows, you may use the Output made for you for your own study, your applications and your own social media, subject to these Terms and to the rights of others (for example, a teacher's rights in a lecture). Output is made by automated systems, and similar Output may be made for other users.
10.3 Licence to us. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, transcribe, translate, analyse, adapt and create Output from Your Content, and to display it to you, for as long as we need to provide Manas to you, keep it safe and working, and meet our legal obligations. This includes sharing Your Content with our service providers for these purposes, as the Privacy Policy explains. The licence ends when Your Content is deleted, except for copies we must keep by law, copies in backups until they are overwritten, and records described in the Privacy Policy.
10.4 No training. We do not use Your Content to train AI models.
10.5 Your responsibility. You are responsible for Your Content. You confirm that you have all the rights and permissions needed to provide it to us and for us to use it as these Terms describe, including the permissions in sections 11 and 12.
10.6 What Output contains. Some Output carries the Manas mark and your invite link. Infographics and videos include them by design.
10.7 Lecture material. A lecture and its materials usually belong to the teacher or the institution. Use recordings and the Output made from them for your own study. Do not publish them, or Output that reproduces substantial parts of someone else's work, without permission.
11. Recording classes and other people
11.1 You need permission. Before you record a class, you must have permission from your institution, and from the teacher and anyone else who can be heard wherever the law or your institution's rules require it. Before your first recording, Manas shows you a notice and asks you to confirm that you have permission. Confirming it, and having it, is your responsibility.
11.2 What you must not record. Do not use Manas to record:
- secretly, where that is unlawful;
- conversations you are not part of, or private conversations;
- exams or assessments where recording is not allowed; or
- anyone who has asked not to be recorded.
11.3 Other people in your recordings. Recordings can capture the voices of teachers and classmates. We process them only to make your Output, as the Privacy Policy explains. Do not share recordings, or Output that identifies other people, without their consent.
11.4 Complaints. If we receive a credible complaint about a recording or about Output made from it, we may remove it and suspend the Account involved.
12. Your voice, your face and your photo
12.1 Separate consents. Using your voice in videos and using your face in videos each need your separate consent, given on its own screen. You can withdraw either at any time in Settings → Consents.
12.2 Only your own. You may give Manas only your own voice and your own face. Do not record, upload or choose anyone else's voice, face or photo, even with their permission.
12.3 How we use them. We use your voice sample to create a copy of your voice with a voice service provider, and your face photo or selfie video to prepare your face for videos. We use them only to make the videos you ask for.
12.4 Withdrawing consent. When you withdraw consent, we stop using your voice or face for new videos at once, and delete your voice data (including the copy of your voice held by our voice provider) or your face data, as the Privacy Policy describes.
12.5 AI labels. When a face talks in a video, or a video shows an avatar, the video carries a visible "AI-generated" label and information in the file that identifies it as AI-generated. PhotoBooth pictures carry the same label in a corner and the same information in the file. Do not remove, crop, cover, blur or alter the label or that information when you share a video or a picture, and say that content is AI-generated wherever a platform or the law requires it.
12.6 Avatars and studio voices. Avatars are AI-generated faces of fictional people, not real people. Studio voices are voices we license. You may use them only in videos you make with Manas. Do not present an avatar as yourself or as a real person. A Video CV always uses your own face, never an avatar.
12.7 No deceptive content. You must not use Manas to make or share content that:
- impersonates anyone, or depicts a real person saying or doing something they did not say or do;
- is designed to make people believe that something AI-generated is real;
- misleads an employer, recruiter, institution or anyone else about who you are or what you have done; or
- is sexual, harassing, defamatory or otherwise unlawful.
12.8 Under 18. If you are under 18, faces in your videos do not talk, and PhotoBooth is not available (section 2.3).
12.9 PhotoBooth. PhotoBooth needs its own consent, separate from your voice and your face, and is for users 18 and over. Add only a photo of yourself, with no one else in it, even with their permission. We use your photo only to check it and make the pictures you ask for, and we keep it for 30 days so you can try other styles (the Privacy Policy explains how). There is a daily limit on pictures, shown in the app. Sections 12.5 and 12.7 apply to every picture you make and share.
13. AI output
13.1 AI can be wrong. Output is produced by automated systems, including AI models run by our service providers. It may be inaccurate, incomplete, out of date or inappropriate, and it may misunderstand what was said in a recording. Check anything important with your teacher, your textbook or another reliable source before you rely on it.
13.2 Not professional advice. Manas is a study tool. Its Output is not medical, mental health, legal, financial, academic or career advice, and it does not replace a qualified professional.
13.3 If you need help now. If you are in distress, call the Tele-MANAS helpline on 14416. In an emergency, call 112.
13.4 Your responsibility. You are responsible for how you use Output, including following your institution's rules on academic integrity when you use it in coursework.
14. CV and career tools
14.1 No guarantee. The CV check, its fixes and job matching are suggestions based on common practices of applicant tracking systems and on the information you give us. We do not guarantee that any employer, recruiter or system will accept, read or rank your CV in any particular way, and we do not guarantee interviews, internships, job offers, admissions or grades.
14.2 Your facts. You are responsible for the accuracy of your CV and your Video CV. A Video CV speaks in the first person, from your CV, and you approve every line of its script before it is made. Do not include false or misleading information. Manas is designed to use only facts you give it, and you should check every CV and video before you send it.
15. Acceptable use
You must not, and must not help anyone else to:
- use Manas in breach of any law, or of the rights of others, including privacy, publicity and intellectual property rights;
- upload or create content that is unlawful, harassing, hateful, threatening, defamatory, obscene, sexually explicit, or that sexualises or endangers a child;
- try to get around safety checks, consents, age protections, limits or prices;
- use bots, scripts, automation, emulators or multiple accounts to earn credits, points, rewards or prizes, or to manipulate leaderboards;
- exploit a bug or error for gain (tell us about it instead);
- resell, rent or commercially exploit Manas, credits or Output, except posting your own videos on your own channels;
- copy, modify, reverse engineer, decompile or scrape Manas, except where the law expressly allows it;
- interfere with or overload Manas, test its security without our written permission, or upload malware;
- use Manas to monitor or record people without their knowledge where that is unlawful; or
- use Manas to cheat in an exam or assessment.
16. Our intellectual property
Manas, including the app, its software, design, text, the Manas and Vitra.ai names and logos, and the Manas robot, belongs to Vitra.ai or its licensors and is protected by law. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Manas app on devices you own or control, for your own use. If you send us feedback or ideas, we may use them without any obligation to you.
17. Third-party services
Manas works with services from other companies, including Google (sign-in, Google Play, AdMob and Google Analytics for Firebase), Apple (Sign in with Apple and the App Store) and the service providers listed by category in our Privacy Policy. Their own terms and privacy policies apply to your use of their services. We are not responsible for third-party services or websites we link to.
18. Privacy
Our Privacy Policy explains what personal data we collect, why, who we share it with, how long we keep it, and your rights, including how to access, correct and delete your data. It forms part of these Terms.
19. Availability and changes to Manas
We aim to keep Manas available, but we do not promise that it will always be available, uninterrupted or free of errors. We may suspend Manas, or any part of it, for maintenance, security or reasons outside our control. If we decide to stop offering Manas altogether, we will give you reasonable notice in the app, and we will deal with any unused purchased credits as the law and the Store's policies require.
20. Suspension and termination
20.1 By you. You can stop using Manas at any time and delete your Account in Settings → Delete my account. Cancel any App Store subscription in the App Store first (section 6.4).
20.2 By us. We may suspend or close your Account, or limit your access to features, if you breach these Terms, if we must do so by law, or if your use creates a risk for other users, for us or for others. Where reasonable, we will tell you why and give you a chance to respond, unless the law or a risk of harm prevents it.
20.3 What happens then. When your Account is closed, your right to use Manas ends, your credits end (section 5.9), and we delete your data as the Privacy Policy describes. Sections 5.1, 5.8, 10, 13, 14, 15, 16, 21, 22, 23, 24 and 28 continue to apply.
21. Disclaimers
To the extent the law allows, Manas and all Output are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. Nothing in these Terms excludes any warranty or right that cannot be excluded under the law that applies to you.
22. Limitation of liability
22.1 To the extent the law allows, Vitra.ai will not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, opportunity, profits, marks or reputation, arising from your use of Manas or Output.
22.2 To the extent the law allows, our total liability to you for all claims arising out of or relating to Manas or these Terms is limited to the greater of (a) the amount you paid for Manas in the 12 months before the event giving rise to the claim, and (b) ₹[minimum liability amount].
22.3 Nothing in these Terms limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot be limited under the law, including your rights under the Consumer Protection Act, 2019.
23. Indemnity
To the extent the law allows, you agree to indemnify Vitra.ai against claims, losses and reasonable costs arising from your breach of these Terms, Your Content, or your violation of anyone else's rights, including by recording people without permission or misusing anyone's voice or face.
24. Governing law and disputes
These Terms are governed by the laws of India. Subject to the next sentence, the courts at [governing-law city] have exclusive jurisdiction over any dispute arising out of or relating to these Terms or Manas. Nothing in this section takes away any right you have to bring a complaint before a consumer commission or other forum that the law makes available to you. Please contact our Grievance Officer first (section 25); most problems can be solved quickly that way.
25. Grievances
If you have a complaint about Manas, Your Content, Output, your personal data or these Terms, contact our Grievance Officer:
- Grievance Officer: [grievance officer name and email]
- Address: [registered address]
We will acknowledge your complaint within 24 hours and aim to resolve it within 15 days. For a complaint about your personal data, if you are not satisfied with our response, you may approach the Data Protection Board of India once our grievance process is complete.
26. Contact
[Vitra.ai legal entity name] [registered address] Email: [support email]
Parents and guardians can reach us at the same address and email.
27. Changes to these Terms
We may update these Terms from time to time. We will tell you about material changes in the app or by email before they take effect, and show the date of the latest version at the top of this page. If you continue to use Manas after a change takes effect, you accept the updated Terms. Where the law requires your consent to a change, we will ask for it.
28. General
- Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about Manas.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right, we do not give it up.
- Assignment. We may transfer these Terms to a successor, for example as part of a merger or sale of our business. You may not transfer your rights or obligations under these Terms.
- Events outside our control. We are not responsible for failures or delays caused by events outside our reasonable control.
- Language. These Terms are written in English. If we provide a translation and there is a difference, the English version applies, unless the law requires otherwise.
29. Additional terms for Apple App Store users
These terms apply if you downloaded Manas from Apple's App Store, and they apply in addition to the rest of these Terms. If they conflict with the rest of these Terms, this section applies.
29.1 Acknowledgement. These Terms are between you and Vitra.ai only, not with Apple Inc. (Apple). Vitra.ai, not Apple, is solely responsible for Manas and its content. These Terms do not set usage rules for Manas that conflict with the Apple Media Services Terms and Conditions in force on the date you accept them.
29.2 Scope of licence. Your licence to use Manas is a non-transferable licence to use the Manas app on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that Manas may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. (Plan credits are not shared through Family Sharing, as section 6.4 explains.)
29.3 Maintenance and support. Vitra.ai is solely responsible for providing any maintenance and support for Manas, as stated in these Terms or as required by law. Apple has no obligation at all to provide any maintenance or support for Manas.
29.4 Warranty. Vitra.ai is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Manas fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of Manas to you. To the maximum extent the law allows, Apple has no other warranty obligation at all with respect to Manas, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to a warranty are Vitra.ai's sole responsibility.
29.5 Product claims. Vitra.ai, not Apple, is responsible for addressing any claims by you or any third party relating to Manas or your possession or use of it, including (a) product liability claims; (b) any claim that Manas fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy or similar legislation. These Terms do not limit Vitra.ai's liability to you beyond what the law allows.
29.6 Intellectual property rights. If a third party claims that Manas, or your possession and use of it, infringes that third party's intellectual property rights, Vitra.ai, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
29.7 Legal compliance. You represent and warrant that (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
